By downloading, accessing, purchasing, subscribing to, or using XMagic, you agree to these Terms of Use, our Privacy Policy, and all applicable store, platform, and legal requirements. If you do not agree, do not use the service.

1. Acceptance and Eligibility

You may use XMagic only if you can form a binding agreement and only in compliance with applicable law. Some features may require a minimum age, account access, purchase entitlement, or confirmation that you have rights to the media and likenesses you submit.

XMagic is not intended for children under 13 and is not directed to the Apple Kids Category. Users must not submit content involving minors in a sexual, exploitative, unsafe, or unlawful context.

AI portrait, avatar, face, likeness, or body-editing features are intended for users who are at least 18 years old or the age of majority required in their region. You may be asked to confirm eligibility, content rights, or consent before using these features.

2. Platform Terms, Apple EULA, and Google Play

If you access XMagic through the Apple App Store, Google Play, or another distribution channel, you also agree to the applicable store terms, usage rules, payment rules, and subscription management processes.

  • For Apple-distributed versions, Apple's standard Licensed Application End User License Agreement applies unless a valid custom EULA is provided through App Store Connect.
  • These Terms supplement platform terms and do not replace any mandatory rights or obligations imposed by Apple, Google, or applicable law.
  • For Google Play-distributed versions, in-app purchases for digital goods and subscriptions are handled through Google Play Billing unless Google Play policies permit another flow.
  • You must not use XMagic to bypass, mislead, or interfere with Apple App Store review, Google Play review, platform payments, store disclosures, security controls, or policy enforcement.
  • Apple is not responsible for providing maintenance or support for XMagic, except as required by applicable law.
  • Apple and its subsidiaries are third-party beneficiaries of the Apple-related portions of these Terms and may enforce them where applicable.
  • Apple and Google do not endorse any representation about XMagic quality, functionality, AI outputs, or content unless they expressly state otherwise.

3. Account, Security, and Deletion

You are responsible for activity under your account, device, or credentials. Keep your access secure and notify us if you believe your account has been compromised.

Where account creation is available, XMagic provides a way to initiate account deletion in supported app builds or through support if you cannot access the in-app flow. Account deletion is permanent and may remove creation history, points, preferences, and associated personal data that we are not legally required to keep. Account deletion does not cancel store-managed subscriptions.

Google Play users may also use the external deletion path on the Privacy Choices page if they have uninstalled the app or cannot access the in-app deletion flow.

4. License and Permitted Use

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use XMagic for personal or internal lawful purposes.

You may not:

  • copy, modify, reverse engineer, decompile, or derive source code from the service except where law clearly permits it;
  • mirror, resell, sublicense, rent, lease, transfer, distribute, or commercially exploit the service without authorization;
  • remove proprietary notices, marks, legal statements, or rights management information;
  • bypass paywalls, purchase checks, rate limits, moderation, security controls, or technical restrictions;
  • interfere with networks, infrastructure, payment systems, SDKs, store systems, or other users.

5. User Content, Face Data, Likeness, and Rights

You retain ownership of content you upload and eligible outputs you generate, subject to these Terms, the rights of third parties, applicable law, and any rules of the stores or services used to distribute or process the content.

By submitting content, you represent and warrant that you have all rights, licenses, permissions, and consents needed to upload, process, edit, generate, store, display, and use that content. If a photo or video contains a person's face, body, voice, private information, or recognizable likeness, you must have that person's explicit consent before using it in XMagic.

You grant XMagic's operator a limited license to host, store, reproduce, process, transmit, transform, display, and create outputs from your submitted content solely as needed to operate, secure, support, improve, and enforce XMagic and as described in our Privacy Policy.

Any face data or facial features visible in submitted media are handled according to the Privacy Policy and are not used for advertising, marketing, data mining, identity verification, or building independent facial-recognition profiles.

For Seedance 2.0 / 2.0 Fast tasks, submitted prompts, selected photos, videos, audio, task settings, and any visible face data or likeness in the submitted media may be sent to XMagic backend services and BytePlus ModelArk, the third-party AI service provider used to generate the requested video and perform safety checks, only after the required in-app consent.

For AI avatar, portrait, likeness, or face workflows, you agree that you are above the required age, you will not upload images of children, and you will upload only your own media or media for which you have explicit permission from every identifiable person.

6. AI Outputs and Responsible Use

AI-generated results may vary in quality, accuracy, recognizability, originality, style consistency, or suitability. Outputs may be incomplete, unexpected, offensive, inaccurate, or similar to content generated for other users. You are responsible for reviewing outputs before saving, publishing, sharing, or using them.

  • Do not present AI outputs as authentic photos, videos, statements, events, or endorsements when that would mislead people.
  • Do not use outputs to impersonate someone, defame someone, commit fraud, harass, threaten, or violate privacy or publicity rights.
  • Do not create or promote deceptive manipulated media about elections, emergencies, sensitive events, public figures, news organizations, or matters of public concern.
  • Do not rely on XMagic for legal, medical, financial, safety-critical, identity verification, or other professional decisions.
  • Some prompts, uploads, or outputs may be blocked, filtered, removed, delayed, or reported for safety, legal, platform, or policy reasons.

If an AI output appears offensive, unsafe, non-consensual, infringing, or otherwise violates these Terms, use the in-app report flow where available or contact support@yes366.com.

7. Prohibited Content and Conduct

You must not create, upload, process, publish, share, sell, or promote content or conduct that is illegal, harmful, abusive, misleading, infringing, or inconsistent with Apple App Store and Google Play safety requirements.

  • pornographic, sexually explicit, exploitative, non-consensual, or sexualized content involving real people or minors;
  • unauthorized deepfakes, intimate imagery, face swaps, impersonation, identity deception, or non-consensual likeness use;
  • content involving child sexual abuse material, child sexual abuse or exploitation, grooming, sextortion, trafficking, abuse, self-harm encouragement, or graphic violence;
  • hateful, discriminatory, defamatory, bullying, harassing, threatening, extremist, or targeted abusive material;
  • false information, scams, fraud, fake official documents, fake financial or identity records, misleading medical or safety claims, or deceptive political content;
  • content that exploits recent tragedies, violent conflicts, epidemics, or emergencies in a harmful or predatory way;
  • content that impersonates a person, government, brand, platform, news service, or official entity without authorization or clear lawful context;
  • copyright, trademark, publicity, privacy, or other intellectual property violations;
  • spam, unauthorized advertising, scraping, malware, credential theft, security probing, hidden behavior, or attempts to evade moderation, review, billing, or platform rules.
Enforcement: violations may result in blocked generation, content removal, loss of sharing features, account suspension, account deletion, reporting to platforms or authorities, or other action permitted by law.

8. Public Sharing, Reports, and Moderation

Some app versions may include public, community, or shared content areas. If you publish or share content, you are responsible for that content and for ensuring it complies with these Terms and applicable law.

  • By creating, uploading, publishing, or sharing user-generated content, you agree to these Terms and the content rules above.
  • Use in-app report tools where available to report offensive, infringing, non-consensual, or unsafe content.
  • Use blocking, restriction, mute, privacy, or similar controls where available to reduce unwanted interaction.
  • We may review reports, remove content, restrict accounts, or preserve records where needed for safety or compliance.
  • Users can contact support@yes366.com about abuse, IP claims, privacy concerns, child safety concerns, or urgent safety issues.

9. Subscriptions, Points, and Billing

XMagic may offer auto-renewable subscriptions, consumable points, promotional offers, trials, and other in-app purchases. The exact product name, price, subscription period, renewal terms, trial length, and included benefits are shown before purchase in the app and store purchase sheet.

  • Subscriptions provide access to premium features, creation credits, faster queues, higher limits, special models, or other benefits described at purchase.
  • Auto-renewable subscriptions renew automatically at the end of each period until canceled through the store account that made the purchase.
  • Payment is charged to your Apple Account, Google Play account, or other applicable store account when the purchase is confirmed.
  • On Android versions distributed through Google Play, paid digital goods, consumable points, and subscriptions are purchased through Google Play Billing unless Google Play policies permit otherwise.
  • Trials or promotional offers may convert to paid subscriptions unless canceled before the trial or promotional period ends.
  • Consumable points or credits may be spent when a task starts, may not be restored after successful generation, and may expire or be limited as described in the app.
  • Taxes, currency conversion, and regional pricing may apply depending on your storefront and local requirements.

Cancellation and management

If you purchased through Apple, manage or cancel in Apple Account subscription settings. If you purchased through Google Play, manage or cancel in Google Play subscription settings. Uninstalling the app or deleting your XMagic account does not automatically cancel a store-managed subscription.

Restore purchases

Use the in-app restore-purchases control where available to recover eligible store purchases or subscription entitlements on a new device or after reinstalling the app.

10. Refunds, Failed Tasks, and Service Credits

Store purchases and subscription refunds are handled by the store where the purchase was made. We may, at our discretion and where technically possible, restore points, extend access, or provide support if a paid task fails because of a service error.

We do not guarantee refunds, replacement credits, or particular output quality for dissatisfaction caused by prompt choice, source media quality, style preference, moderation blocks, or factors outside our control. The final results depend on the quality, variety, legality, and policy compliance of the content you submit.

11. Third-Party Services

XMagic may rely on third-party services for AI workflow processing, storage, analytics, crash reporting, attribution, payment entitlement, and distribution. These services may have their own terms and privacy policies. You must not use XMagic to violate the terms or rights of third-party services, platforms, or content owners.

For Seedance 2.0 / 2.0 Fast video generation, XMagic uses BytePlus ModelArk as a third-party AI service provider. The data sent for that workflow may include submitted prompts, selected media, task settings, and any visible face data or likeness in the media. This data is sent only to complete the requested AI task and related safety checks, as described in the Privacy Policy.

XMagic does not control third-party platforms, websites, or online services, and is not responsible for their actions, policies, purchases, content, or data practices.

12. Availability and Changes

We may modify, suspend, remove, limit, or discontinue features, models, templates, prices, points, promotions, or content at any time, subject to applicable law and store rules. AI generation may be delayed or unavailable because of service load, maintenance, provider outages, queue limits, moderation, or network issues.

13. Termination

We may suspend or terminate access to XMagic if we reasonably believe you violated these Terms, abused the service, created legal or safety risk, infringed rights, bypassed controls, or engaged in prohibited conduct. You may stop using the service at any time and may request account deletion as described in our Privacy Policy.

14. Disclaimers and Limitation of Liability

XMagic is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted operation, error-free performance, data availability, compatibility, or perfect output quality.

To the extent permitted by law, XMagic's operator will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost content, reputational harm, or business interruption arising out of or related to your use of the service.

15. Governing Law and Severability

These Terms are governed by applicable law, without limiting any mandatory consumer protections that apply in your location. If a specific clause is found unenforceable, the remaining clauses remain in effect.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date and post the updated version on this page. Continued use of XMagic after an update may indicate acceptance of the revised Terms where permitted by law.
