XMagic Pro Terms of Use
By downloading, accessing, or using XMagic Pro, you agree to these Terms of Use and to all applicable laws, store rules, and platform requirements. If you do not agree, you must stop using the service.

1. Acceptance and Eligibility

You must use XMagic Pro only in compliance with applicable law and any platform-specific terms that apply to the Apple App Store, Google Play, or other distribution channels.

Certain features may require you to be above a minimum age or to confirm that you have the legal right to upload and process the content you submit.

2. License and Permitted Use

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use XMagic Pro for personal or internal lawful use.

You may not:

  • copy, modify, reverse engineer, decompile, or derive source code from the service except where law clearly permits it;
  • mirror, resell, sublicense, transfer, or exploit the service in an unauthorized way;
  • remove proprietary notices, marks, or legal statements;
  • disrupt infrastructure, interfere with networks, or attempt to bypass access or safety controls.

3. Prohibited Content and Conduct

You must not use XMagic Pro to create, upload, process, or distribute content that is illegal, abusive, infringing, or harmful.

  • obscene, pornographic, sexually explicit, or indecent material;
  • non-consensual sexual content or unauthorized deepfake content;
  • content involving minors, nudity involving minors, exploitation, abuse, or violence;
  • harassing, hateful, fraudulent, defamatory, or unlawful material;
  • spam, unauthorized advertising, or attempts to evade moderation or safety systems.
Enforcement: violations may result in content removal, feature limitation, account suspension, termination, or additional action where permitted by law.

4. User Content and Intellectual Property

You retain ownership of content you upload, subject to any rights you grant to us so that we can operate, improve, secure, and maintain the service.

By submitting content, you represent that you have the necessary rights and permissions to use it. You grant us a license to host, process, reproduce, adapt, transmit, and display that content solely as needed to deliver and improve the service and as otherwise described in our Privacy Policy.

All intellectual property rights in XMagic Pro itself, including software, interfaces, branding, and underlying materials, remain owned by or licensed to ArtVibe Hong Kong Limited.

5. AI Outputs and Quality Expectations

AI-generated results may vary in quality, accuracy, recognizability, style consistency, or suitability. You acknowledge that outputs may not always match expectations and that the service may occasionally produce unsatisfactory, incomplete, or unusable results.

Output quality may depend on prompt quality, image quality, source material, templates, service load, moderation requirements, and technical factors outside our direct control.

6. Subscriptions and Billing

XMagic Pro may offer auto-renewing subscriptions, including weekly or yearly plans, and may also provide limited-time promotional pricing or free trial periods.

  • Subscriptions begin when your initial payment is confirmed.
  • Auto-renewal continues unless canceled through the relevant store account settings.
  • Applicable taxes may be added depending on region and platform rules.
  • Trial offers, promotional pricing, and availability may be changed or withdrawn at our discretion.

Cancellation

If you purchased through Apple, manage cancellation through your Apple subscription settings. If you purchased through Google Play, manage cancellation through your Google Play subscription settings.

7. Platform Terms

If you access XMagic Pro through Apple or Google distribution channels, you also agree to comply with their applicable usage rules, payment rules, and store policies.

Apple and its subsidiaries may be treated as third-party beneficiaries of the applicable iOS-related portions of these terms where platform rules require.

8. Termination

We may suspend or terminate access to XMagic Pro, with or without notice, if we reasonably believe that you violated these terms, abused the service, created risk for users or the platform, or engaged in prohibited conduct.

9. Disclaimers and Limitation of Liability

XMagic Pro is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not guarantee uninterrupted operation, error-free performance, or perfect output quality.

To the extent permitted by law, ArtVibe Hong Kong Limited will not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the service.

10. Governing Law

These terms are governed by the laws specified by ArtVibe Hong Kong Limited and any applicable local legal requirements. If a specific clause is found unenforceable, the remaining clauses remain in effect.
